General terms and conditions of business

This English version is provided for convenience only. In case of discrepancies, the German version shall prevail.

1. Scope and Provider

(1) These General Terms and Conditions apply to all contracts between

Pimpun Klein, Auszeit – Thai Massage & Wellness, Filderhauptstraße 10, 70599 Stuttgart, Germany (hereinafter "Provider")

and her customers for treatments at the studio and for the purchase of vouchers, regardless of whether the contract is concluded online, by telephone or on site.

(2) A consumer within the meaning of these terms is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity (Section 13 German Civil Code, BGB).

2. Services

(1) The Provider offers wellness and relaxation massages, waxing and eyelash treatments. The type, duration and price of the services are set out in the current service description on the website or the price list in the studio.

(2) The massages serve relaxation and well-being. They are not medical treatments, therapeutic treatments or physiotherapy. They do not replace a visit to a doctor or any medical diagnosis or therapy.

3. Conclusion of Contract

(1) Online appointment booking: The presentation of the services on the website is not a binding offer. By submitting the booking in the online booking system, you make a binding offer to conclude a treatment contract. The contract is concluded when the Provider confirms the booking by e-mail or in the booking system. For services that can only be booked "on request" (e.g. treatments of 120 minutes), the contract is only concluded upon the Provider's express confirmation.

(2) Voucher purchase: The vouchers in the online shop are not a binding offer. By submitting the order via the order button in the online shop, you make a binding purchase offer. The contract is concluded when the Provider confirms the order by e-mail. Payment is then made by bank transfer (clause 4).

(3) By telephone and on site, the contract is concluded when the Provider confirms the appointment.

(4) The contract text is not stored by the Provider. You can print or save the booking or order data and these terms when the contract is concluded. The contract language is German.

4. Prices and Payment

(1) The prices stated at the time of booking or order apply. All prices are final prices in euros including statutory value added tax.

(2) Treatments are to be paid in cash after the treatment at the studio.

(3) Vouchers are to be paid in advance by bank transfer. We will inform you of the bank details and the payment period of 14 days with the order confirmation. The voucher will only be sent or handed over after receipt of payment. For dispatch by post, postage and packaging costs of EUR 3.00 apply; for collection at the studio, these costs do not apply.

5. Appointments, Lateness, Cancellation

(1) Agreed appointments are binding. Please arrive on time. In case of lateness, the treatment time is shortened accordingly and the full price remains payable, unless the lateness is the Provider's responsibility.

(2) Appointments can be cancelled or rescheduled free of charge by telephone, e-mail or via the booking system up to 24 hours before the start.

(3) In case of later cancellation or no-show, the Provider may charge a cancellation fee of 50% of the agreed price. The customer is free to prove that a lower damage or no damage has occurred. The Provider is free to prove a higher damage.

(4) If the Provider has to cancel an appointment, for example due to illness, a replacement appointment will be offered promptly. Further claims exist only in accordance with clause 8.

6. Cooperation and Health Information

(1) Please inform the Provider before the treatment of any health conditions that may be relevant to the treatment, in particular pregnancy, cardiovascular diseases, thrombosis, acute inflammation, skin diseases, allergies, operations, injuries, cancer or the use of blood-thinning medication. This information is voluntary; without it, however, the Provider may not be able to carry out the treatment, or only to a limited extent.

(2) The Provider may refuse or discontinue a treatment if health or hygiene reasons speak against it or if customers significantly disturb the treatment or behave inappropriately. In this case, unless the discontinuation is the Provider's responsibility, the treatment is charged proportionally.

(3) Pregnancy massage: It is only possible from the 4th month of pregnancy. Please discuss the treatment with your doctor beforehand.

(4) Waxing and eyelash treatment: Please point out allergies, skin irritations, medication (e.g. isotretinoin) and sensitivities in advance.

(5) The processing of the health data you provide is governed by the privacy policy.

7. Vouchers

(1) Vouchers are issued in the values stated in the online shop and, after receipt of payment, are sent by post on request or held for collection at the studio. They can be redeemed for services of the Provider. A cash payout of the voucher value or interest is excluded. If the value of a treatment is lower than the voucher value, the remaining balance is credited and can be redeemed at a later appointment. If the value is higher, the difference is to be paid.

(2) The voucher is valid until the end of the third year following the year of purchase (statutory limitation period). Example: purchase in October 2026, valid until 31 December 2029.

(3) Vouchers are transferable. The Provider may perform to the person who presents the voucher, unless the Provider knows or grossly negligently does not know that this person is not entitled.

(4) No replacement is provided for lost or stolen vouchers unless they can be clearly identified by the order number.

(5) The statutory right of withdrawal for voucher purchases in distance selling is set out in the cancellation policy.

8. Liability

(1) The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act.

(2) In case of slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely), liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.

(3) For valuables and clothing brought along, liability exists only in case of intent or gross negligence.

9. Right of Withdrawal

Consumers have a statutory right of withdrawal for distance contracts, unless a statutory exception applies. The details are set out in the separate cancellation policy.

10. Data Protection

Information on the processing of personal data can be found in the privacy policy at https://www.auszeitnehmen.com/datenschutz

11. Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the state in which the consumer has their habitual residence is not withdrawn.

(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Stuttgart.

(3) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(4) Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected. The statutory provision replaces the invalid provision.
